Affidavit of service filed in Court is taken on record. The petitioners are aggrieved that despite complaint dated 5th July, 2022, Bhowanipore Police Station has not taken any steps.
State is not represented.
The private respondents lodged a complaint which was registered as FIR being No. 200 of 2022 dated 4th August, 2022 before the Bhowanipore Police Station under Sections 341/323/379/114 of the IPC. It is submitted that the private respondents are also on bail.
Counsel for the private respondents submits that his client obtained a decree for eviction against the petitioners and do not intend to adopt any extra judicial measures to deal with the petitioners.
In the above circumstances, this Court directs the parties to maintain absolute peace and tranquillity in the area. Parties may approach the civil court for appropriate
remedies, inter alia, for execution of any decree that they may have obtained against one another in accordance with law.
The O. C., Bhowanipore Police Station shall ensure that there is no breach of peace in the area. With the aforesaid observations, the writ petition is disposed of.
There will be no order as to costs.
