The petitioner contested the Panchayat General Elections, 2023.
He alleges illegality at the time of counting. The submission of the petitioner is opposed by the Assistant Panchayat Returning Officer, who is personally present in Court with a written note signed by the Panchayat Returning Officer dated 18th July, 2023.
On a perusal of the facts as mentioned in the note forwarded by the Panchayat Returning Officer, it
appears that there are several disputed questions of facts which cannot be ascertained by this Court. In view of the above, no relief can be granted to the petitioner in the instant writ petition.
The writ petition stands dismissed.
It will be open to the petitioner to file appropriate election petition in accordance with law, if so advised. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
