The writ petitioner has a grievance against his neighbour, who also happens to be his paternal cousin brother. There is a bad blood between the parties. A complaint has been registered with the Penro Police Station on 24th November, 2021 on an accident that took place on 29th October, 2021. The FIR has been registered and investigation is on.
It is submitted that the private respondents have surrendered before the learned Magistrate and are on bail.
Counsel for private respondents submits that it is his clients, who have been ousted from the said premises and are being threatened by the writ petitioner. He further submits that an FIR has also been registered in that effect.
Counsel for the State submits on instructions received from the Penro Police Station and the same is taken on record.
It appears that FIR has been registered on the basis of a complaint by the petitioner and the private respondents. Investigation into the FIR must be completed as expeditiously as possible, preferably within a period of two months from the date of communication of a copy of this order.
The Officer-in-charge, Penro Police Station is directed to ensure that there is no breach of peace in the area.
It is submitted by the Counsel for the State that the writ petitioner's mother is not co-operating with the investigation. Counsel for the petitioner submits that his client's mother is willing to so co-operate. However, if there is no co-operation from the petitioner's mother, the police shall draw up or take out appropriate proceedings in accordance with law. With the aforesaid observations, the instant writ petition shall stand disposed of.
There will be no order as to costs.
