Ct.No.28 as (Rejected) C.R.M. (DB) 2897 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Barabani P. S. Case No.254 of 2022 dated 12.12.2022 under Sections 394/397 of the Indian Penal Code and Sections 25(1b)(a) of the Arms Act.

In the matter of : Kumar Das & Anr.

... Petitioners.

Mr. Gopal Chakraborty.

...for the Petitioners.

Mr. Neguive Ahmed, ld. A.P.P., Ms. Trina Mitra.

...for the State.

Petitioners are in custody for 225 days. Petitioners submit they were released on bail earlier. Subsequently, their bail prayer was cancelled. There is no possibility of their abscondence.

Learned Advocate for the State opposes the bail prayer. He submits petitioners have been identified in the T. I. Parade. We have considered the materials on record. Allegation involve robbery at gun point. Victim has identified the petitioners as miscreants.

In view of the materials on record and gravity of offence, we do not find it prudent to enlarge the petitioners on bail. Accordingly, the prayer for bail of the petitioners is rejected.
