1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Petitioner made an application for transfer on Utsashree Portal on 16th March, 2022. School authority where petitioner is presently working forwarded the transfer application of the petitioner to the concerned District Inspector of Schools (SE) on 10th April, 2022. On receipt of transfer application concerned District Inspector of Schools (SE) forwarded the same to the West Bengal Central School Service Commission on 12th April, 2022 through portal for taking decision. Grievance of the petitioner is transfer application is yet to be decided.

3. Respondents are represented by learned advocates who have submitted perhaps due to suspension of portal with effect from 29th September,

contemporaneous decision could not be taken on transfer application of the petitioner.

4. However, it is submitted on behalf of West Bengal Central School Service Commission if concerned authority is directed transfer application of the petitioner shall be decided in accordance with law.

5. Having considered the submissions made on behalf of the parties writ petition stands disposed of directing Secretary, West Bengal Central School Service Commission being respondent no. 4 to decide transfer application of the petitioner by 6 (six) weeks from the date of communication of this order. Decision to be taken by the respondent no. 4 shall be communicated to the petitioner by 10 days thereafter.

6. It is made clear that suspension of portal shall not be a ground to reject transfer application of the petitioner.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
