1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Petitioner made transfer application last on 10th July, on Utsashree Portal on general ground (distance). Transfer application of the petitioner was forwarded by the school authority where petitioner is presently working to the concerned District Inspector of Schools (SE) for taking further steps. District Inspector of Schools (SE) in his turn processed the transfer application and forwarded the same to the West Bengal Central School Service Commission for taking decision. Grievance of the petitioner is his transfer application which was made on 10th July, 2022 is yet to be decided. Petitioner prays for consideration of his transfer application by treating

the same as an application made on the ground of distance in between the present school of the petitioner and his place of residence.

3. Respondents are represented by learned advocates who have submitted perhaps due to suspension of portal contemporaneous decision could not be taken on transfer application of the petitioner.

4. On behalf of West Bengal Central School Service Commission it is submitted if concerned authority is directed transfer application of the petitioner shall be decided in accordance with law.

5. Having considered the respective submissions made on behalf of the parties writ petition stands disposed of directing the Secretary, West Bengal Central School Service Commission being respondent no. 4 to decide transfer application of the petitioner by 6 (six) weeks from the date of communication of this order. Decision to be taken by the respondent no. 4 shall be communicated to the petitioner by fortnight thereafter.

6. It is made clear that suspension of portal shall not be a ground to reject transfer application of the petitioner.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
