1. Petitioner is in custody for 140 days. He submits he is not the principal accused. He prays for bail.

2. Learned lawyer for the State opposes the bail prayer.

3. Learned lawyer for the de facto complainant also oppose the bail prayer.

4. We have considered the materials on record. Petitioner and others restrained the victim and he was assaulted on the head. PostMortem report also shows head injury resulting death.

5. In view of the aforesaid circumstances, and gravity of the offence we are not inclined to grant bail to the petitioner.

6. The bail application, is thus, rejected.
