The grievance of the petitioner relates to an order and judgment dated 09.02.2012 passed by the learned CJM, Barasat in connection with Misc. Case No.452 of 2011 under Section 127 of the Code of Criminal Procedure.
Records of the revisional application reflect that the learned CJM, Barasat was pleased to enhance the interim maintenance from Rs.1,000/- per month to a sum of Rs.5,000/- per month.
Having regard to the reasons so assigned by the learned Magistrate and the fact that the order was passed in the year 2012, I am of the view that no interference is called for belatedly. Accordingly, CRR 2375 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
The opposite party will be entitled to recover the arrears by taking an appropriate application before the learned Magistrate. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
