Mr. Dipankar Mandal ... for the Chakdah Municipality The petitioner is aggrieved by the act of the Chakdaha Municipality for not permitting him to participate in a tender floated by the Municipality in June, 2022.

The grievance of the petitioner is that the tender documents were not supplied to him and accordingly he could not participated in the tender process. The petitioner claims to have made representation before the Municipality and also before the District Magistrate.

At this stage the petitioner prays for a direction upon the Municipality to file a report.

It appears from the documents annexed to the writ petition that the tender was floated on 20th June, 2022 and the last date and time of the application was 28th June, 2020. Last date and time for purchase was 8th July, 2022. Last date and time for dropping the tender

paper was 15th July, 2022 and the date and time of opening the tender papers was 16th July, 2022. The petitioner approached the Court by filing this writ petition on 1st August, 2022.

Learned advocate for the Municipality submits that the Work Order was issued on 19th July, 2022. No reason has been mentioned in the writ petition preventing the petitioner for approaching this Court immediately after his application for obtaining the tender papers was refused.

The Court is of the opinion that at such a delayed point of time it will not be proper to re-open the entire tender process and to start a roving enquiry on the same. Moreover, the time for completion of the works put to tender was only thirty days. The said time has also expired.

In view of the above, no relief can be granted to the petitioner in the instant case.

The writ petition fails and is hereby dismissed. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. ( Amrita Sinha, J.)
