Petitioner is an employee of West Bengal Gramin Bank who was placed under suspension vide order dated 20th December, 2023.

It is submitted by the learned advocate representing the petitioner that disciplinary proceeding was culminated into an order whereby petitioner was not removed or dismissed from service.

It is also submitted that vide order dated 6th February, 2025 concerned Bank Authority revoked order of suspension pursuant thereto petitioner resumed duty on 7th February, 2025.

Relying upon Regulation 48(2) of Paschim Banga Gramim Bank (Officers and Employees) Service Regulations, 2010 petitioner has prayed for entire salary during the period of suspension on adjusting subsistence allowance.

Learned advocate representing the Bank Authority

has opposed this writ petition and it is submitted that two separate disciplinary proceedings were initiated against the petitioner by issuing two charge sheets. One disciplinary proceeding is culminated into an order of punishment to the extent of reduction of basic pay at the initial stage in the time scale of pay which he belongs to as officer Scale III for a period of five years. 6.

But another disciplinary proceeding is not concluded as the issue is pending before this Court and petitioner is enjoying an order of stay.

It is also submitted that petitioner has not disclosed on different allegations two separate disciplinary proceedings were initiated against him, out of which one proceeding is brought to a logical conclusion.

Having considered the respective submissions made on behalf of the parties and taking note of the fact that out of two disciplinary proceedings initiated against the petitioner one proceeding is still pending, Regulation 48(2) of Paschim Banga Gramim Bank (Officers and Employees) Service Regulations, 2010 is not attracted.

After completion of another disciplinary proceeding which was initiated against the petitioner or if the said proceeding is set aside by this Court in the

pending writ petition, petitioner shall be at liberty to approach this Court seeking identical relief.

10. With the aforesaid observations, writ petition stands disposed of.

11. There shall be no order as to costs.

12. Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
