Affidavit of service filed on behalf of the petitioner and the report submitted by the State are taken on record. The defacto complainant is not represented despite service. Learned counsel for the petitioner submits that the petitioner is in custody for three months. He has not been identified in T.I. Parade. His further detention is not required. Learned counsel for the State opposes the prayer. I have considered the material on record.

The victim lady has implicated the petitioner in her statement recorded under Section 164 of the Code of Criminal Procedure. The medical report prepared contemporaneously supports the statement of the victim.

Considering the nature and gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is disposed of.
