ASG Mr. Kumar Jyoti Tewari ... for the respondents The writ petition is disposed of permitting the petitioner to apply before the concerned criminal court for necessary orders relating to a direction upon the authorities for issuance of passport, which shall be considered by the learned court as per the relevant rules/notifications. The court will decide the matter independently and impose such terms and conditions as the court deems fit.

It appears at page 14 of the writ petition that the petitioner had applied for passport in the normal form and not tatkal, although the authority rejected the claim on the ground that the application in the tatkal mode could not accepted. If the learned criminal court passes an order on the petitioner's application before it, the matter will be processed by the passport authorities on the basis of the application which appears at page 14 and 15 of the writ petition. If the authority finds any defect in the said application, then an opportunity shall be given to the petitioner to file a fresh application in the

proper mode. Thereafter, the same shall be processed.

The writ petition stands disposed of.

All the parties are directed to act on the basis of the server copy of the order.
