Petitioner is aggrieved by the fact that since a case is pending being Islampur PS case no. 359/2021 dated 08.11.2021 which is registered under the provisions of the Essential Commodities Act, 1955 and 10125 Kgs. of jute have been seized which is the subject matter of the said case and a prayer advanced before the learned A.C.J.M., Lalbagh was referred to the District Magistrate/District Collector who according to the petitioner till date did not consider or adhere to the directions, so passed.
I find that a representation was sent on or about 28.05.2025 to the District Magistrate, Murshidabad. Accordingly, the District Magistrate or any authorized officer deputed by him will consider the representation of
the petitioner in consonance with the provisions of the Essential Commodities Act.
Learned advocate for the State would through the Officer-in-Charge, Islampur Police Station inform the District Magistrate in respect of such representation. A notice be issued to the petitioner within a period of 30 days.
With the aforesaid observations WPA 16885 of 2025 is disposed of.
Needless to state that this Court has not gone into the merits of the case but has only issued directions as the A.C.J.M. Lalbagh's direction till date has not been complied with.
Report so submitted by the State be kept with the record.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
