Roy Ms. Madhumita Sadhukhan ... for the petitioner This application under Article of the Constitution of India is at the instance of the defendant no.5 praying for a direction upon the learned Civil Judge (Senior Division), Basirhat, North 24 Parganas to dispose of an application for recalling filed by the petitioner on 9th January, 2025 expeditiously.
Mr. Mitra, learned advocate appearing for the petitioner draws the attention of the Court to an order passed by this Court on February 18, 2025 in C.O. 498 of 2025 in support of his contention that earlier a direction was passed upon the learned trial judge to dispose of the same expeditiously. He submits that the hearing of such application has been fixed on 6th August, 2025. He further submits that the said application is otherwise ready for hearing.
In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing
for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned trial judge.
In the light of the submissions made by the learned advocate for the petitioner, C.O. 2686 of 2025 stands disposed of by requesting the learned Civil Judge (Senior Division), Basirhat, North 24 Parganas to take up the hearing of the application for recalling dated 9th January, 2025 on the next date fixed i.e. on August 6, 2025, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible but preferably within a period of twelve weeks from the next date fixed without granting any unnecessary adjournments to either of the parties.
There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
