In The High Court At Calcutta Constitutional Writ Jurisdiction Appellate Side W.P.A 16949 of 2023 Bablu Mondal & Anr.

-versus The State of West Bengal & Ors.

Mr. Sabyasachi Chatterjee, Mr. Mrinal Kanti Sardar, Mr. Sandipan Das.

...For the Petitioners.

Ms. Sonal Sinha, Mr. Tarun Chatterjee, Mr. Sujit Gupta, Mr. Sayan Datta, Mr. Soumen Chatterjee ...For the State Election Commission.

Mr. Lalit Mohan Mahata, Mr. Ziaul Haque.

...For the State.

The petitioners seek re-poll on the ground of illegalities and malpractice on the day of the poll. I have perused the reports filed by the Presiding Officer, the State Election Commission and the Panchayat Returning Officer.

It appears that the issues involved in the instant writ petition cannot be decided without taking evidence. It will be open for the petitioner to approach the appropriate forum for remedy, if permissible in law. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
