Petitioners are aggrieved by the fact that in spite of the representation furnished pursuant to the directions passed by this Court, police authorities did not respond to the same and, as such, the petitioners are suffering.

Learned advocate for the State has submitted a report which categorically records in paragraph 15 as follows:

"Very recently one fresh complaint has been submitted by the petitioner Sabitri Mundari which could be received at the PS on 26-07-2025 through postal communication. The very complaint could be received at PS Part-IV Revenue Register vide Sl. No.-136/25. As per endorsement ( of IC

Nadanghat PS ) SI Uttam Layek conducted an enquiry over this alleged petition. The concerned enquiry officer had been to the very site ( of the disputed land property ) and enquired the matter physically on the spot in presence of all. During enquiry it could be seen that the petitioner ( Sabitri Mundari ) has already constructed a pacca building there and staying there as her dwelling house. The E.O. talked with the opponent party ( i.e. Respondent Bhagirath Sarkar ) who clearly stated that he having no objection to any construction activity by the petitioner but everything should be done observing all administrative formalities specially taking due permission of the local Panchayat authority."

Having considered that there has been change of circumstances, further interference at this stage is unwarranted. However, the police authorities being the law enforcing agency would oversee that no untoward incident or any breach of the peace and/or tranquility takes place.

With the aforesaid observations, WPA 16951 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioners. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
