28.08.2024 rc/ct.no.34 Item No.68 CRR No.2890 of 2024 with CRAN No. 1 of 2024 In the matter of : Esraful Momin @ Bhadu & Ors. .......Petitioners Mr. Sujoy Sarkar Mr. Susharaf Alam ...for the Petitioners Petitioners have assailed the order passed by the learned Sessions Judge, Malda on March 18, 2024 in Sessions Case No. 91 of 2024 issuing warrant of arrest against them due to their non-appearance before the learned Court on that date. The petitioners were on bail and upon commitment of the case record to the learned Sessions Judge, March 18, 2024 was fixed for appearance of the petitioners before the learned Sessions Court and confirmation of bail. The petitioners were unable to appear before the learned Court on the said date for which warrant of arrest was issued.

The petitioners undertake to surrender before the learned Sessions Judge, Malda within 7 days from date and pray for remaining on the same bail bond.

In the event the petitioners surrender before the learned Sessions Judge within 7 days from date, they shall be allowed to remain on the same bail bond by the learned Sessions Judge. Warrant of arrest issued against the petitioners be stayed till September 06, 2024.

If the petitioners failed to surrender before the learned Court within the stipulated time frame, the learned Court shall be at liberty to take necessary steps against the petitioners in accordance with law without further reference to this Court. CRR No. 2890 of 2024 is disposed of.

The connected application being CRAN No. 1 of 2024 is disposed of accordingly.
