Item No. 66.

Court No.13 ap W.P.A. No. 18009 of 2021 Ashok Kumar Nayak

Versus

The State of West Bengal & Ors.

Mr. Bhaskar Chandra Manna.

...For the petitioner.

Despite service of notice, the respondents are not represented. Affidavit-of-service filed in Court today be taken on record.

The writ petitioner is aggrieved by the alleged inaction on the part of Contai Police Station, in rendering assistance to him to remove a lock over the latrine and bathroom at his tenanted premises. It is also prayed, that assistance be given for repair of a damaged roof.

Admittedly, the petitioner is a tenant under the private respondent. The petitioner has been depositing rent towards the tenanted premises with the Rent Controller.

This Court sees that the disputes between the petitioner and the private respondent are civil in nature, and has no public element. Contai Police Station have absolutely no role to play in this case and have rightly stayed away from the matter.

The remedy of the petitioner, if any, against the private respondent before a civil or other statutory forum is reserved to be agitated.

With the aforesaid observations, the instant writ petition must fail, and is hereby dismissed.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
