Affidavit-of-service filed by the petitioner be kept with the record.

Petitioner claims that the petitioner happens to be owner of a property where there has been continuous interference at the behest of the private respondents and, as such, the petitioner is unable to enjoy the property. To that effect, information was furnished with the Officer-in-Charge, Raninagar Police Station on or about 11th May, 2025. However, no steps have been taken.

State has submitted a report. Report reflects that already a civil suit is pending before the learned Civil Judge (Senior Division), Berhampore being Case No.120 of 2015. It has also been submitted on behalf of the State that proceedings have been drawn under Sections 126/135 of the BNSS.

In view of the nature of the dispute having the cloak of a civil dispute, I direct that the police authorities would only keep a strict vigil and would take steps if there is any crisis of law and order. With the aforesaid observations, WPA 16910 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

Copy of the report be handed over to both the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
