Mr. Abdur Rakib Mr. Dhiman Banerjee ...for the petitioner It is submitted that an application under section 5 of the Limitation Act, which was filed in connection with Criminal Appeal No.31 of 2022, is pending before the learned Sessions Judge, Birbhum, Suri. The petitioner by way of this revision seeks for early disposal of it.

After hearing the petitioner, I am of the view that the said application should be disposed of at the earliest. Hence, the learned Sessions Judge, Birbhum, Suri would dispose of the condonation of delay application (section 5) on the next date so fixed by her or within a fortnight thereafter. With the aforesaid observations, CRR No.2657 of 2023 stands disposed of.

Pending application, if any, is consequently disposed of. Parties are to act on the server copy of this order duly downloaded from the official website of this court. Certified copy of this order, if applied for, shall be made available to the parties.
