Heard learned counsels for the parties.

The order passed by the competent authority under The Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (hereinafter referred to as "the Act of 1962") on December 26, 2022 is assailed in the writ petition.

The petitioner seeks liberty to take necessary steps before the learned District Judge, Paschim Bardhaman in terms of Sections 10(2) and 10(3) of the Act of 1962. In view of the above, the writ petition being WPA No. 16967 of 2023 is dismissed for non-prosecution. Liberty is granted to the petitioner to approach the Court of the learned District Judge, Paschim Bardhaman for redressal of his grievance.

There shall, however, be no order as to costs. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
