The petitioner is the President of Tamluk Nagar Mandal of the Bharatiya Janata Party. The petitioner seeks to hold an event including a procession on 9th August, 2022 to commemorate the 80th Anniversary of Quit India Movement.

Learned counsel appearing for the petitioner submits that the rally would be held from 9 a.m. to 12 noon on 9th August, 2022.

Learned Senior Standing Counsel appearing on behalf of the State hands up an alternative route to the court and for consideration of counsel appearing for the petitioner on the ground that 9th August, 2022 is also the day for observing Muharram. Counsel further submits that another procession is due to be held on that day itself in Tamluk.

Upon considering the alternative route which has been agreed upon by counsel for the petitioner, W.P.A.17466 of 2022 may be disposed of with a direction on the petitioner to hold the event including a procession as has been planned by the party in question in Tamluk on 9th August, 2022 along the following route:- Tamluk Hospital more - Mechobazar -Bargabhima Temple - Tamralipta Municipality - Jailkhana more - Banpukur.

The only request made to the petitioner is to ensure that the procession, if any, reaches Jailkhana More by 11 a.m. on 9th August, 2022. Since this court reposes confidence on learned counsel appearing for the parties, the usual directions with regard to the petitioner not causing breach of peace in the area are deemed not to be necessary in the facts of the present case.
