The petitioner is aggrieved by the fact that in spite of the order passed under Section 5 of Maintenance and Welfare of Parents and Senior Citizens Act, 2007 on 11.06.2025 in connection with Paschim Bardhaman No. 165 of 2025 by the learned Sub Divisional Magistrate, Durgapur & Chairman, Maintenance Tribunal, Durgapur, no steps have been taken by the police authorities. Petitioner draws the attention of the Court to the earlier order dated 14.05.2025 passed by this Court. Petitioner also submits that subsequently directions have been passed upon the police authorities.

State has submitted a report which reflects that police authorities did not find any tangible evidence so far as the accusation of the petitioner is concerned.

If the petitioner is aggrieved that pursuant to direction upon the police authorities by the Sub Divisional Magistrate, Durgapur & Chairman, Maintenance Tribunal, Durgapur, no steps have been taken, it would be for the petitioner to approach the same Sub Divisional Magistrate bringing the breach of the order so that directions may be passed upon superior officers of police for enforcement of the directions passed by the Sub Divisional Magistrate.

With the aforesaid observations, the writ petition being WPA 16980 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
