Learned counsel for the petitioner contends that the petitioner is the owner of the premises but having to enjoying electricity connection at the mercy of his tenant, in whose name the connection is standing at present.

Learned counsel for the CESC Limited submits that the CESC Limited has refused to give such connection since the petitioner is already enjoying electricity from the existing connection at the premises and the entire premises is structurally composite. It is further pointed out that, under Clause 14 of Regulation 53 of 2013, the dispute in respect of splitting of load, as raised by the distribution licensee, has to be referred to the Grievance Redressal Officer concerned. Upon hearing learned counsel for the parties and without entering into the merits of the rights and contentions of the petitioner in respect of the premises,

leave is granted to the petitioner to approach the concerned Grievance Redressal Officer with the dispute as raised in the present writ petition.

If so approached, the Grievance Redressal Officer shall give an adequate opportunity of hearing to all concerned, including both the parties, and decide the dispute in accordance with law as expeditiously as possible, preferably within four weeks from the reference being made.

WPA 17469 of 2022 is, accordingly, disposed of. There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
