WPA 17470 of 2022 Ashish Kumar Chaurasia 05-12-2022 AKG Ct. 238 Vs.

Union of India & Ors.

Mr. Debasish Kundu ...for the Petitioner Mr. Rajat Dutta ...for the Respondent No. 8 Mr. D. N. Maiti, Mr. S. Ghoshal ...for WBUHS Mr. Indranil Roy, Mr. Sunit Kumar Roy ...for National Medical Commission Petitioner seeks admission in MBBS Course at Bankura Sammilani Medical College and Rampurhat Medical College. His rank was 42771 in All India Merit list.

It is the case of the petitioner that he was not given admission in the said colleges though one Juhi Koley with an inferior rank was accommodated at the Bankura Sammilani Medical College.

It has been submitted by Mr. Indranil Roy, learned advocate appearing for National Medical Commission that rank of Juhi Koley was 3,64,829. Mr. Rajat Dutta, learned advocate appearing for Bankura Sammilani Medical College has produced the Scheduled Tribe Certificate of Jauhi Koley. He submits that Juhi was admitted under the Scheduled Tribe Quota.

Therefore, I am of the view that there was no infirmity in admitting Juhi Koley in the said Medical College.

It should also be noticed that the last date for admission in undergraduate course is March 31 of that particular academic year and the same was subsequently, extended by Hon'ble Supreme Court till April 28, 2022 for the relevant academic year. In view of the last date of admission fixed by the Hon'ble Supreme Court, no relief can be granted to the petitioner.

WPA 17470 of 2022 is dismissed.
