The written instructions submitted on behalf of the State respondents in WPA 18859 of 2021 is taken on record.
The writ petitioners in WPA 18859 of 2021 and WPA 18869 of 2021 are aggrieved by the selection of the private respondents as the highest bidders in the tender floated by the District Land & Land Reforms Officer, Malda.
Learned counsel appearing for the State respondents submits that though the petitioners in WPA 18045 of 2021 and WPA 19105 of 2021 were declared as highest bidders, documents were called for from these petitioners in support of their case and the process is still pending.
Learned counsels appearing for the parties submit that the matter may be remanded back to the District Magistrate, Malda for consideration within a stipulated period of time.
Having considered the submissions made on behalf of the parties, this Court is of the view that the writ petitions may be considered as representations and dealt with by the District Magistrate, Malda after giving reasonable opportunity of hearing to all the interested parties/their legal representatives, in accordance with law.
Such exercise be completed within a month from the date of communication of this order.
With the above directions, the aforesaid writ petitions, namely, WPA 18859 of 2021, WPA 18045 of 2021, WPA 18869 of 2021 and WPA 19105 of 2021 are disposed of. However, there shall be no order as to costs.
Since no affidavits are invited, the allegations contained in these petitions are deemed not to be admitted.
