The learned advocate for the petitioner submits that the proceedings before the learned Additional Chief Judicial Magistrate, Alipore, 24 Parganas (South) is in the stage of recording evidence. Initially, there was a stay, however, that did not continue further. The petitioner may be given at liberty to agitate the issues in the instant criminal revisional application before the learned trial court. He further submits that he does not want to proceed further with the instant revisional application and also not pres the same since the issue in question being dealt with at the trial court and the petitioner does not intend to proceed with the instant revisional application any further.
The revisional application being CRR 1897 of 2013 is dismissed for non prosecution.
