The petitioner prays for a mandamus upon the panchayat authorities to remove the alleged encroachment over the petitioner's land. Such encroachment was at the instance of the third parties. The representations made before the District Magistrate, Hooghly, Block Development Officer, Dhaniakhali Block and the Pradhan, Gurbari No. 2 Gram Panchayt, indicate that the grievance of the petitioner is solely against the private parties who had allegedly erected a fencing on a part of the petitioner's land which had been used by the petitioner for ingress and egress to his dwelling house.

Such private dispute cannot be decided by the panchayat authorities.

The writ petition is disposed of without any orders.

The liberty of the petitioner to approach the learned civil court, is kept open.

However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
