Report in the form of affidavit filed by the Block Development Officer, Lalgola Block is taken on record. It appears therefrom that the Block Development Officer took into consideration the objection filed by the petitioner on the day of the poll. At the time of scrutiny no anomaly was found, accordingly, the Block Development Officer did not recommend for re-poll at the polling station.

Report further mentions that during counting of votes no anomaly was reported from any of the candidates or their counting agent in writing. Only after

the result was declared and the winning candidate won by a very short margin, the issue has again been raised. The Court is of the opinion that in the facts and circumstances of the instant case, no relief can be granted to the petitioner.

The writ petition fails and is hereby dismissed. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
