Amritolal Chatterjee, learned counsel appearing on behalf of the alleged contemnor submits that appeal being MAT 1329 of 2025 pending before the Hon'ble Division Bench has been dismissed.

He further submits that in pursuance to the direction of this court the concerned respondent authorities/alleged contemnor has passed an order dated 9th September, 2025 thereby they have practically complied the direction of this court.

Mr. Chatterjee has handed over the order dated 9th September, 2025.

The last two paragraphs of the said order appear to be relevant and hereby reproduced hereinunder. Memo No. 632/SC/FS/Ali(S)/25 Dated 09/09/2025

ORDER

"Whereas on inspection was held on 04th Apri, 2025 at the FPS shop of M/S Khadya Bhandar (13430300002)..................................................... from quashing of the order of suspension."

"Now, in view of the above and in compliance of the order passed by Hon'ble High Court of Calcutta, the suspension order issued vide memo No.

296/SC/FS/Ali(S)/25 dated 23/04/2025 on Khadya Bhandar is hereby withdrawn and the M R license of M/S Khadya Bhandar (34345800076) has been restored with immediate effect.

The concerned Area Inspector F& S is hereby instructed to transfer stock from the tagged MR dealer Suchitra Halder bearing License No 34345800072 to restored MR Dealer M/S Khadya Bhandar (34345800076) and send stock transfer report thereof."

Sub-Divisional Controller Food & Supplies & E.O Dy. Director, Alipore(S), S-24pgs This court vide order dated 2nd July, 2025 has stayed the order of suspension issued against the petitioner dated 23rd April, 2025 which was further modified vide show cause suspension letter dated 17th June, 2025.

This court also directed the respondent authority to resume the supply of M.R. commodity to the FPS to the petitioner with immediate effect. In terms of the said direction the Sub-Divisional Controller, Food & Supply concerned withdrawn the order of suspension dated 23rd April, 2025 and directed

concerned area Inspector, Food & Supply sent the stock to the petitioner's FPS and submit a report thereof. If original order of suspension dated 23.04.2025 was withdrawn, subsequent order dated 17.06.2025 is also considered to be withdrawn.

Taking note of the compliance made herein above through an order dated 9th September, 2025 it appears that the alleged contemnor has already complied the order.

Accordingly, there is no necessary to proceed further with the instant contempt application. Accordingly, the instant contempt application being CPAN 1284 of 2025 is disposed of.

Rule, if issued, is hereby recalled.
