Petitioner is aggrieved by the fact that his tenant 01.08.2025 Court No. 35 D/L. No.51 Rakib has been entertaining third persons which is the cause of nuisance being created, thereby disrupting the peaceful enjoyment of the property.

Learned advocate appearing for the respondent no.4 dispute and denies the contention and submits that the information sent to the police authorities and the contents in the writ petition are completely different and no third party till date has been allowed to enter the tenanted premises.

State has submitted a report. According to the State the petitioner and the private respondents are related to each other as such they have entered into a family feud where the police authorities have restrained themselves from interfering.

Be that as it may, since there is presently an inimical relationship existing, police authorities would

ensure that no public nuisance is created and to that extent would take steps, if required and also ensure that no breach of the peace and/or tranquility take place. With the aforesaid observations WPA 16858 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
