The petitioner's grievance is that, despite having applied duly, the CESC Limited is not giving new electric connection to the petitioner.

Learned counsel for the CESC Limited contends that there is already an electric connection to the said premises and, as such, there is a suspicion of splitting of load in the event a further connection is given in the name of the petitioner.

Learned counsel appearing for the private respondent-landlord adopts such contention and

submits that the petitioner is already enjoying an electric connection from the existing meter.

Be that as it may, it appears from the representation given by the petitioner, annexed at page-30 of the writ petition, that there is a perceived threat that the private respondent-landlord shall disconnect such electric connection.

In view of the question of splitting of load having arisen, the petitioner is directed to approach before the Grievance Redressal Officer (GRO) for ascertaining the aspect of splitting of load and to decide on the issue upon hearing all the interested parties. The private respondent, being the respondent no.3 herein, shall not disconnect the electric supply to the petitioner's shop room till the matter is resolved finally before the GRO and/or, if a further challenge is preferred before the Ombudsman within limitation, prior to adjudication by the Ombudsman.

Accordingly, WPA No.18073 of 2021 is disposed of.

There will be no order as to costs.
