The petitioners are the erstwhile members of Saoraberia Jalpai-I Gram Panchayat. The petitioners allege that although their terms expired in 2018, they have not been paid the honorarium, to which they were allegedly entitled, for the period 2013 to 2018. The petitioners further allege that during their tenure as members of the gram panchayat, the honorarium had been enhanced by notifications issued by the Department of Panchayats and Rural Development, Government of West Bengal. It is contended that the petitioners have received some payment during the pendency of the writ petition, but most of the dues are still outstanding.

The correctness of the allegations of the petitioners cannot be gone into by this court in the absence of records. The court deems it fit to dispose

of the writ petition with a direction upon the Block Development Officer, Mahishadal-1 Block, to dispose of the demand of justice dated January 19, 2022, in accordance with law.

While deciding the issues, a representative of the petitioners as also other interested parties including the Pradhan, Saoraberia Jalpai-I Gram Panchayat, shall be heard.

reasoned order shall be passed and communicated to all concerned.

If the authorities find that the petitioners are entitled to the claims as stated in the writ petition, necessary direction shall be issued for payment. If the authorities find that the petitioners are not entitled to the payments as claimed in the writ petition or entitled to partial payment, reasons for such findings shall be provided in the said order. The entire exercise shall be completed within a period of three months from the date of communication of this order.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
