The State of West Bengal & Ors.

AKG Ct. 238 Mr. Ekramul Bari, Sk. Imtiaj Uddin ...For the Petitioner Mr. Anirban Sarkar ...for Respondent Nos. 3 & 4.

It is the grievance of the petitioner that he was initially employed at Raja Peary Mohan College as an Assistant Professor for the period between May 11, 2005 and September 30, 2015 and thereafter he was released with lien to join Jawaharlal Nehru University as Associate Professor.

The petitioner submits that he is entitled to prorata pension and other benefits for the service rendered by him at Raja Peary Mohan College.

It appears that the principal of the relevant college as well as the petitioner made representations before the Director of Public Instructions, West Bengal for release of the said benefits.

Considering the aforesaid facts, this writ petition is disposed of with a direction upon the Director of Public Instructions to consider the representations appearing at page 26 and page 27 of the writ petition in accordance with law within a period of two months from the date of communication of the order.

The Director of Public Instructions shall be at liberty to hear the college as well as the petitioner before passing such order. The reasoned order should be communicated to the petitioner within one-week thereafter. Accordingly, WPA 17016 of 2023 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
