The petitioner was an Assistant Teacher of Sundarpur High School, District : Murshidabad. The petitioner is praying condonation of shortfall of his qualifying service to get the pensionary benefits.

A representation of the petitioner praying such condonation was pending before the Principal Secretary, School Education Department, Government of West Bengal, the respondent no.4 herein.

This Court by the order dated August 31, 2023 had directed the respondent no.4 to consider and dispose of the said representation and to file a report before this Court.

Mr. Singh, learned Counsel for the State respondents files such report, which is taken on record.

It appears from the said report that the prayer of the petitioner was examined in terms

of the provision of Death-cum-Retirement Benefits (DCRB) Scheme, 1981 and considering the past service of the petitioner as para-teacher, the prayer of the petitioner has been allowed. In view of such development, the petitioner is entitled to pensionary benefits.

The Authorities are directed to take appropriate forward steps for disbursement of the pension of the petitioner in accordance with law.

W.P.A. 17020 of 2023 is thus disposed of without any order as to costs.
