The State of West Bengal and others Mr. Debasis Sur, Mr. Hare Krishna Harde, Mr. Himadri Shekhar Paul, Mr. Anujit Maity .... for the petitioners Mr. Anand Farmania, Mr. Vijay Agarwal .... for the State Learned counsel for the petitioners contends that the petitioners had applied for allotment of lands, in the context that the petitioners fall within the Refugee Rehabilitation Scheme and are in occupation of the property-in-question. However, such repeated applications by the petitioners have fallen on deaf ears. It is, thus, submitted that such pattas may be granted to the petitioners under the Refugee Rehabilitation Scheme.

Heard learned counsel for the parties.

WPA No. 17022 of 2023 is, accordingly, disposed of by directing the respondent no. 3, the Sub Divisional Officer, Kalyani to consider the representations of the petitioners with regard to the

allotment of pattas to the petitioners under the Refugee Rehabilitation Scheme prevalent in the area, subject to the petitioners complying with all prerequisites and fulfilling all the tests for grant of such pattas.

The entire exercise of assessing the petitioners' entitlement in that regard, upon giving opportunity of hearing and of production of relevant documents/other materials to the petitioners, shall be concluded as expeditiously as possible, positively within two months from this date.

Immediately thereafter, in the event the petitioners are found entitled to get such pattas, the respondent authorities shall grant such pattas in favour of the petitioners, concluding such process within one month thereafter.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
