IN THE HIGH COURT AT CALCUTTA

Criminal Revisional Jurisdiction 05-09-2023 Subha Item no. 109 Ct no.34 CRR 2928 of 2022 Rajkumari Banerjee.

-versus- Vedant Chem(P) Ltd. and Ors.

Mr. Sarbesh Pal ....for the petitioner.

Learned advocate for the petitioner is anxious for the fact that the case was initiated in the year 2015, but till date there has been no progress in the case even after eight years have passed. It has been submitted that the accused persons in a designed manner are evading the process of court. The court is issuing warrant of arrest and again the accused persons are evading the court. Therefore, again warrant of arrest is issued and the same is continuing for a considerable period of time. I have considered the submissions and perused the ordersheets passed by the learned Judicial Magistrate, Alipore and in the circumstances, I direct that if the learned trial court in the circumstances find that the accused persons are intentionally evading the trial, he would impose conditions of local surety, if required. The learned trial court would fix at least one date in every 15 days so that the trial of the case can be concluded within a reasonable period of time. All efforts be taken by the parties concerned and no unnecessary adjournments be granted to any of the parties.

Accordingly, the revisional application being CRR 2928 of 2022 is disposed of.

Pending applications, if any, are hereby disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
