04.08.2022 sdas rejected C.R.M.(DB) No. 2622 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Dhubulia Police Station Case No. 372 of 2021 dated 06.12.2021 under Sections 326/307/120B of the Indian Penal Code added Section 302 of the Indian Penal Code.

And In Re : Rakhi Ghosh ..... petitioner Mr. Prabir Majumder ... for the petitioner Mr. Sudip Ghosh Mr. Apurba Kumar Datta ... for the State Learned Counsel appearing for the petitioner submits she is in custody for 237 days. Petitioner prays for bail. Learned Counsel appearing for the State opposes the prayer for bail and submits victim made a dying declaration implicated the petitioner in her murder.

We have considered the materials on record. Dying declaration of the victim implicates the petitioner in her murder. In view of the aforesaid incriminating materials on record and gravity of the offence, we are not inclined to grant bail to the petitioner.
