Heard learned Advocates appearing for the parties. Petitioner has filed this writ petition being aggrieved by the inaction on the part of the respondent No.3, Chairman, CBDT in considering and taking a final decision on the application of the petitioner dated 25th February, 2022 being Annexure P-12 to the writ petition which was filed in response to the letter of the Board dated 7th February, 2022 being Annexure P-11 to the writ petition.

Petitioner is a Government Body and it is highly unfortunate that more than one and half years have been passed after making the aforesaid application dated 25th February, 2022 yet the authority concerned is not finding time to consider and dispose of the aforesaid application of the petitioner.

Mr. Sharma, learned Advocate appearing for the respondent/Board could not explain and justify such delay on the part of the respondent/Board in

considering and disposing of the aforesaid application of the petitioner.

Considering the facts and circumstances of the case as appears from the record and submission of the parties this writ petition being WPA 17034 of 2023 is disposed of by directing the CBDT authority concerned/respondent No.3, to consider and dispose of the aforesaid application of the petitioner dated 25th February, 2022, by taking a final decision, within six weeks from date.

Needless to mention that if the respondent/Board intends to take any decision adverse to the interest of the petitioner, in that case petitioner shall be given an opportunity of personal hearing.
