4. Since the appellants claim themselves guarantor of the borrower whose property was sold, we add the appellants as party-respondents in the appeal. We grant leave to the appellants to prefer the appeal.

5. As the writ petitioner does not wish to proceed with the writ petition itself, impugned order passed in the writ petition is set aside.

6. MAT of and all connected applications are disposed of without any order as to costs.
