Mr. Partha Sarathi Ghosh, Mr. Sandip Dinda ...For the Governing Body Admittedly, the name of the petitioner was recommended for the post of Principal in Moyna College, Purba Medinipur by the West Bengal College Service Commission by a letter dated February 5, 2021. The college, however, did not issue any appointment letter or allowed the petitioner to join. The said letter dated February 5, 2021, indicates that the recommendation was valid for two months from the date of the letter. It is the prayer of the petitioner that the validity period of the recommendation letter should be extended and the petitioner should be allowed to join the post in question. Mr. Subhrangsu Panda, learned advocate representing the College Service Commission submits that the College Service Commission has recommended the name of the petitioner and there is no further role to be played by the College Service Commission.
Mr. Partha Sarathi Ghosh, learned advocate representing the College submits that at the relevant point
of time, there was no President in the managing committee of the college. Therefore, no appointment letter could be issued in favour of the petitioner. He, however, submits that the college is now ready and willing to allow the petitioner join the post in question since presently the Governing Body of the college is functioning with a President.
In view of the submissions made by the parties, the college is directed to allow the petitioner to join the post in question on the basis of the recommendation made by the College Service Commission by its letter dated February 5, 2021, by issuance of an appointment letter within one week from the date of communication of this order The petitioner will be at liberty to join the post within one week thereafter.
Accordingly, WPA 17514 of 2022 is disposed of. Let urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
