The petitioner prays that he may be allowed to resume his duties as a 'Skilled Technical Person' under the Chakdignagar Gram panchayat, where he had been serving till his services were discontinued on the allegation of commission of offences punishable under the Indian Penal Code. The petitioner was subsequently acquitted by the learned Special Court by the order dated November 22, 2021. Relying on the judgment, the petitioner approached the authorities for being considered for the post of 'Skilled Technical Person' for implementation of the MGNREGS scheme. According to the petitioner, the schemes are in the process of execution and as such, the requirement for 'Skilled Technical Person' has not been done away with. The Additional District Programme Coordinator, MGNREGA and the Additional District Magistrate (ZP) Nadia shall dispose of the representation of the petitioner, which is

Annexure-P/9 at Pages-35 to 37 of the writ petition in accordance with law.

The petitioner will be given an opportunity of being heard. The Pradhan of the concerned gram panchayat shall also be heard. Accordingly, a reasoned order shall be passed and communicated to all concerned.

The entire exercise shall be completed within a period of two months from the date of communication of this order. The writ petition is disposed of accordingly. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
