Affidavit-of-service filed by the petitioner be kept with the record.

Petitioner is aggrieved by the inaction of the Officer-in-Charge, Joynagar Police Station as in spite of informing the concerned police station against the private respondents, no steps were taken. Petitioner claims to be shebait of a trust.

Records reflect that a suit being T.S.151 of 2015 was initiated at the behest of the private respondent no.4. However, the same has been dismissed for default.

State has submitted a report. Report reflects that there is a land dispute existing and police

authorities have kept a vigil as also drawn up proceedings under Section 126 of the BNSS.

Having considered that there is a civil dispute existing between the petitioner and the private respondents, I am of the view that police authorities will only interfere in case there is any violation of law and order.

With the aforesaid observations, WPA 16824 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
