Learned advocate appearing for the petitioner submits that petitioner is similarly placed as other accused persons who have been granted bail.
Learned advocate for the petitioner submits petitioner is in custody for more than 2 years and as such on any stringent condition the petitioner may be released on bail. Learned advocate for the State has drawn the attention of the Court to the statement under section 164 Cr.P.C. of some of the witnesses who have been relied upon in the charge sheet.
I have perused and considered the same and I find that the petitioner is similarly situated as other accused persons who have been granted bail, accordingly petitioner shall be extended the same privilege.
Accordingly, the prayer for bail of the petitioner is allowed.
Petitioner, namely, Md. Salim @ Babu shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned CJM, Purulia.
In this case the local surety would be of a person who would deposit the title deed of a property before the learned Court for furnishing bond.
If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Purulia without prior permission of the learned Trial Court.
Accordingly, CRM (M) 1205 of 2025 is allowed. Report submitted be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
