1. Heard learned Counsel for the parties.
2. Mr. Nandy, learned Additional Public Prosecutor submits that service has already been effected on the victim as per requirement of the aforesaid Act.
3. This is an appeal under Section 14A of the SC & ST (PA) Act. The incident is of the year 2022 and some of the co-accused persons are stated to have been released on bail in the meantime. The present petitioner is stated to be on similar footing with the co-accused persons.
4. Regard being had to the facts and submissions and especially, the nature of allegation, it is directed that the appellant shall be released on bail by the learned Special Court - Cum - Additional Sessions Judge, First Court, Alipore, South 24 Parganas in Special Case No. 98 of 2022 on such terms and conditions as deemed just and proper in the facts and circumstances of the case.
5. It is needless to mention here that the conditions imposed by the co-ordinate Bench in respect of other co-accused persons
may be imposed by the aforesaid court while granting bail to the appellant.
6. Accordingly, the appeal being CRA (DB) 223 of 2023 is allowed.
