04.08.2022 sdas rejected C.R.M.(DB) No. 2624 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Asansol North Police Station Case No. 46 of 2021 dated 11.02.2021 under Sections 341/324/326/307/395/511/427/302/120B of the Indian Penal Code and Sections 25/27/35 of the Arms Act and chargesheet submitted under Sections 341/324/326/307/396/427/120B of the Indian Penal Code and Section 27 of the Arms Act.
And In Re : Imam Khan @ Ebrar & Anr. ..... petitioners Mr. Anindya Ghosh ... for the petitioners Mr. Madhusudan Sur, learned APP Mr. Dipankar Paramanick ... for the State Learned Counsel appearing for the petitioners submits they are in custody for over 500 days. It is also submitted that they have been falsely implicated in the instant case. Learned Counsel appearing for the State opposes the prayer for bail and submits petitioners and co-accuseds had committed the offence of dacoity with murder. We have considered the materials on record. Statements of the witnesses show petitioners had close association with other co-accuseds and had committed the crime. Firearm was recovered from the petitioner no. 2.
In view of the aforesaid incriminating materials on record and gravity of the offence, we are not inclined to grant bail to the petitioners at this stage.
