1. Petitioner is in custody for three years. He prays for bail on the ground of delay in trial.
2. Inspite of notice, nobody appears for the victim.
3. Learned lawyer for the State opposes the bail prayer and submits a report which is taken on record.
4. We have considered the materials on record. Victim is a special child and was raped by the petitioner. She is yet to be examined. There is possibility that she may be won over if the petitioner is released on bail.
5. Under such circumstances, we are not inclined to grant bail to the petitioner.
6. We request the learned Trial Court to examine the victim at an early date and conclude the trial preferably within a period of eight months from the next date fixed for recording of evidence without granting unnecessary adjournment to either of the parties.
