The only prayer of the petitioner is for a direction on the West Bengal Nursing Council to consider the case of the petitioner.

Learned counsel appearing for the petitioner submits that the Indian Nursing Council has objected to a Clause of the Guideline for reciprocal registration in West Bengal, particularly Guideline 10 which requires a candidate for the General Nursing and Midwifery Course to obtain a minimum of 40% at the qualifying examination and English individually for any recognized board. The remaining part of the Guideline 10 also relates to qualifying percentage in English and other subjects as well as the minimum age for admission of the candidate.

The State is represented.

The documents show that the petitioner was awarded a Certificate of Registration from Karnataka State Nursing Council on 24th March, 2021 with Diploma in General Nursing and Midwifery after having successfully completed the course, as evident from the completion Certificate awarded to the petitioner on 30th January, 2021.

WPA 17529 of 2022 is accordingly disposed of with a direction on the West Bengal Nursing Council to consider the case of the petitioner for reciprocal registration in West Bengal and dispose of the same by passing a reasoned order in the light of the order passed by this Court in WPA 6168 of 2022 (Pratima Samanta Vs. The State of West Bengal & Ors. ) within a period of four weeks from the date of communication of this order. The West Bengal Nursing Council will be at liberty of hearing the petitioner before passing the reasoned order. A copy of the reasoned order shall be made available to the petitioner within a week from the date of passing such order.
