The petitioner is in custody for more than three years and renews his prayer for bail.

Learned counsel for the petitioner submits that despite specific direction of this Court, the case has not been committed to the learned Sessions Court as yet. Learned counsel for the State opposes the prayer. I have considered the material on record. The victim has implicated the petitioner prior to his death. The petitioner was absconding for about ten years. There are criminal antecedents to his credit. The petitioner does not deserve a favourable order on merits.

However considering the period of his incarceration, the learned trial Court is directed to commit the case to the learned Court of Sessions at the earliest.

Prayer for bail is rejected at this stage.

The bail application is disposed of.
