Case No. 26 of 2017 pending before the learned Additional Sessions Judge, Fast Track, 1st Court, Assansol, Paschim Bardhaman, the matter may be taken up for consideration without service of notice upon the opposite party. The opposite party shall not be prejudiced by an order directing expeditious disposal of the case.

It is shocking to note that despite direction given by a coordinate Bench of this Court on May 11, 2022 in CRR No. 823 of 2022 for disposing of the case within one year from the next date fixed before the learned trial Court, the case is still pending. This Court is informed that out of 28 charge sheeted witnesses, 7 witnesses have been examined till date, the last examination being held on April 28, 2023. The conduct of the learned trial Court demonstrates defiance of the order of this Court. However, the learned trial Court is directed to take the proceedings to its logical conclusion within one year from the next date of hearing fixed before him without granting any unnecessary adjournment to either of the parties, in accordance with law.

It is recorded that this direction is peremptory and mandatory.

With the above observations and directions, the instant revisional application being CRR No. 2910 of 2024 is disposed of. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
